VC Holiday Lighting Service Agreement & Terms and Conditions
1. Scope of Work
VC Holiday Lighting will provide installation, maintenance (if applicable), removal, and storage (if included in package) of holiday lighting as outlined in the approved estimate. Any additions or modifications must be agreed upon in writing and may result in additional charges.

2. Payment Terms
• A non-refundable deposit of 10 % is required to secure installation dates.
• Remaining balance is due upon completion of installation unless otherwise agreed in writing.
• Late payments may incur a 20 % monthly finance charge.
• VC Holiday Lighting reserves the right to remove lighting displays for non-payment.
Failure to remit payment may result in collections proceedings, and Client agrees to pay reasonable collection and attorney fees if applicable.

3. Weather & Force Majeure
Holiday lighting systems are installed outdoors and are subject to weather conditions and environmental factors beyond the control of VC Holiday Lighting, including but not limited to wind, rain, storms, extreme temperatures, power surges, landscaping interference, animals, roof debris, or other acts of nature.
VC Holiday Lighting is not responsible for damage, outages, or performance issues caused by such events. While we will make reasonable efforts to troubleshoot and repair issues during the service period, uninterrupted operation cannot be guaranteed.
Weather-related service calls or damage caused by external factors may be subject to additional service fees.

4. Property & Roof Liability
Client acknowledges that installation may require access to rooflines, trees, landscaping, and other elevated surfaces.
VC Holiday Lighting will take reasonable care during installation and removal; however:
• We are not responsible for pre-existing roof damage, loose shingles, brittle roofing materials, or structural deficiencies.
• We are not responsible for damage resulting from fragile, aged, or improperly maintained surfaces.
• Client warrants that all installation areas are structurally sound and safe.
Any repairs required due to pre-existing conditions are the responsibility of the Client.
5. Electrical & Power Supply
Client is responsible for providing safe, functioning, GFCI-protected electrical outlets. VC Holiday Lighting is not responsible for breaker trips, faulty wiring, insufficient amperage, or power surges originating from the property.
6. Maintenance & Service Calls
If a maintenance package is included, VC Holiday Lighting will respond within a reasonable timeframe during normal business hours.
Service calls resulting from:
• Weather events
• Landscaping interference
• Animals
• Third-party tampering
• Power supply issues
-may be billed separately.
Response times may be extended during peak season or inclement weather.

7. Removal & Storage
Removal will occur within a reasonable timeframe following the holiday season, weather permitting.
If storage is included:
• Decorations remain the property of VC Holiday Lighting unless purchased outright.
• Stored materials may show normal wear over time.
• VC Holiday Lighting is not responsible for deterioration due to normal seasonal use.
​If Client delays removal beyond scheduled dates, additional fees may apply.

8. Ownership of Materials
Unless explicitly purchased by Client, all lighting materials, timers, clips, wiring, and hardware remain the property of VC Holiday Lighting. Tampering, removal, or relocation by Client or third parties voids any service guarantee.

9. Indemnification
Client agrees to indemnify and hold harmless VC Holiday Lighting from any claims, damages, injuries, or liabilities arising from:
• Client interference with installation
• Third-party tampering
• Unsafe property conditions
• Failure to disclose hazards

10. Automatic Renewal (Optional)
Unless Client provides written notice prior to September 1 of the upcoming season, service may automatically renew for the following holiday season at current market rates.

11. Cancellation Policy
• Deposits are non-refundable once scheduling and materials have been allocated.
• Cancellations after installation will require full payment.
• VC Holiday Lighting reserves the right to cancel service due to unsafe conditions.
12. Limitation of Liability
Under no circumstances shall VC Holiday Lighting be liable for indirect, incidental, special, or consequential damages, including but not limited to lost use, inconvenience, or aesthetic dissatisfaction. Total liability shall not exceed the amount paid under this agreement.
13. Governing Law
This agreement shall be governed by the laws of the State of California.
